Who we are

Soho Europe is a company incorporated in the Republic of Ireland. We are the data controller in respect of any personal data collected through this website.

What personal data we collect

When you use the contact form on our website, we collect:

  • Your name
  • Your email address
  • Your phone number, if you choose to provide it
  • The content of your message

We do not collect any other personal data through this website at this time, and we do not collect sensitive special category data under any circumstances.

Our web server may also log basic technical data such as your IP address and browser type for security and diagnostic purposes only.

How and why we use your data

We process your contact form data solely to respond to your enquiry.

Our legal basis for this processing is legitimate interest under Article 6(1)(f) of the GDPR, specifically the mutual interest in communicating with people who have voluntarily reached out to us.

We do not use your data for automated profiling or automated decision-making.

We will never sell, rent, or otherwise transfer your personal data to third parties for marketing or commercial purposes.

Cookies

Our website currently uses only essential cookies, those strictly necessary for the website to operate. Essential cookies do not require your consent under the ePrivacy Regulations.

How long we keep your data

We retain personal data submitted via the contact form for as long as is necessary to handle your enquiry, and for a reasonable period thereafter, typically no longer than 12 months from your last communication with us, unless we are required by law to retain it for longer.

Server log data is retained for a maximum of 90 days.

Who we share your data with

We do not share your personal data with third-party marketing platforms, data brokers, or advertising networks. We will never sell or rent your contact details to anyone.

Soho Chile (affiliated company)

Soho Europe is part of a group of companies that includes an affiliated entity in Chile. In the course of handling your enquiry, there may be circumstances where we involve Soho Chile, for example to provide pre-sales support or to engage them in delivering a service to you. When this is likely to happen, we will inform you before sharing your details.

Our legal basis for any such sharing is legitimate interest under Article 6(1)(f) of the GDPR, specifically the interest in providing you with the most effective service by drawing on the capabilities of our wider group.

Third-party service providers

Should we introduce third-party tools such as CRM, email, or analytics platforms, we will update this policy before doing so and ensure that any processor we engage is contractually bound to handle your data securely and only for the purposes we specify.

We may disclose your personal data to law enforcement or regulatory bodies if required to do so by law.

International transfers

Transfers to Chile

Chile is not currently subject to an EU adequacy decision under Article 45 of the GDPR, meaning it is treated as a third country for the purposes of international data transfers.

Where we share your personal data with Soho Chile, we do so under Standard Contractual Clauses (SCCs), the EU-approved contractual mechanism under Article 46(2)(c) of the GDPR that ensures your data receives an equivalent level of protection to that required within the EEA.

Other international transfers

We do not currently transfer your personal data outside the EEA to any other country. Should this change, we will update this policy and ensure appropriate safeguards are in place before any such transfer takes place.

Your rights

Under the GDPR, you have the following rights in relation to your personal data:

  • Right of access: you can request a copy of the personal data we hold about you.
  • Right to rectification: you can ask us to correct any inaccurate or incomplete data.
  • Right to erasure: you can ask us to delete your data in certain circumstances.
  • Right to restriction: you can ask us to limit how we use your data.
  • Right to data portability: you can request your data in a structured, machine-readable format.
  • Right to object: you can object to processing based on legitimate interest.
  • Right to withdraw consent: where we rely on consent as our legal basis, you can withdraw it at any time. This will not affect the lawfulness of any processing carried out before withdrawal.
